(Fort Lauderdale, Fla.) - Attorneys for local rapper and double murder suspect YNW Melly accused the prosecution of a cover-up this morning in court.
They asked the judge to recuse the entire Broward State Attorney's office from Melly's second murder trial for allegedly withholding evidence during his first trial, which ended in a hung jury.
According to the defense, the prosecution of attempting to cover up the report about alleged misconduct involving the execution of a search warrant. The state denied a cover-up and argued that they are simply exercising their attorney-client privilege.
The prosecution asked Broward Judge John Murphy to quash the defense’s subpoenas for the State Attorney and several assistant state attorneys.
The judge still has not ruled on the recusal motion which is based on the Brady violation but is expected to rule on the motion to quash the subpoenas today.
Melly, whose legal name is Jamell Demons, is due back in court on Friday morning.
